The author, who is highly sympathetic toward her subject, follows Bentham's career from his birth until 1792. She divides these years into the Benthamite categories of learning, knowing and doing. She clearly shows Bentham's debt to Bacon and the philosophes, the origins of his adherence to democracy, the development of his logical innovations out of his legal concerns, and the growing split between his popular writings and the more complex, often more philosophically sophisticated arcana.--W. This is a collection of seventeen articles, beginning with the 1945 essay, "De la Justice." Repeatedly emphasized are Perelman's opposition to "the absolutist ideal" and his insistence on the importance of linguistic considerations in reasoning. The theme of the final article, "what a reflection on law can contribute to the philosopher" epitomizes the spirit of the volume as a whole. The best-interests standard is a widely used ethical, legal, and social basis for policy and decision-making involving children and other incompetent persons. It is under attack, however, as self-defeating, individualistic, unknowable, vague, dangerous, and open to abuse. The author defends this standard by identifying its employment, first, as a threshold for intervention and judgment (as in child abuse and neglect rulings), second, as an ideal to establish policies or prima facie duties, and, third, as a standard of reasonableness. Purpose. Based on the study of philosophical anthropological concepts, to highlight the project of personality in different historical periods, to reveal the meaning of humanistic issues in the postmodern epoch, to identify the essential features of the image of human of the second half of the XX the beginning of the XXI century. Theoretical basis. The methodological basis of the article is the principles of historicism, integrity, objectivity regarding the mastery of the issue of person’s image in postmodernism. The research (...) applied comparative-historical, culturological, analytical, axiological approaches to reveal the problem of individuality in the second half of the XX the beginning of the XXI century. The theoretical basis of the article consists of scientific works in the field of philosophical anthropology, history, cultural studies, and aesthetics. Originality. The author revealed the peculiarities of transformation of the personality model from antiquity to postmodernism, specified the image of man of the second half of the XX the beginning of the XXI century. Conclusions. The analysis of anthropological ideas of Western philosophy of different ages shows the variety of views about understanding the nature of the person, its complexity and ambiguity. In the epoch of postmodernism humanistic issues are of particular relevance, which is connected with social and political uncertainty, domination of mass consciousness, loss of national and cultural identity. The image of a person of this period is deprived of a solid foundation, it is blurred and relative. The destruction of faith in the absolute in the context of the second half of the twentieth century contributed to the formation of confidence in the interdependence of all things, raised the problem of the personality image to a new ontological level. Orientation in the achievements of European civilization, perception of its anthropological experience, intercultural dialogue contribute to the productive use of the achievements of mankind in order to understand the modern person and to form its adequate image. In its essence, postmodernism does not set the goal to realize a retrospection of subject type. However, separating from the cultural memory the excerpts of ideas about a person, by certain styles and directions, it builds on their formations its own eclectic image of the individual. (shrink)

Recalcitrant disputes among health care providers and patients or their families may signal deep cultural differences about what interventions are needed or about clinicians’s professional duties. These issues arose in relation to a mother’s request for hymenoplasty or revirgination for her minor daughter to enable an overseas, forced marriage and protect her from an honor killing. The American College of Obstetrics and Gynecology committee recommends against members performing a hymenoplasty or other female genital cosmetic surgeries due to a lack of (...) data concerning their safety and efficacy. A key issue in such cases is how to determine what is in the minor’s best interest and the scope of health care moral or professional’s duties. The Best Interests Standard can serve as a powerful moral tool for resolving cross-cultural disputes and identifying needed policy. (shrink)

It is also important in that it gives evidence of interesting achievements in the field of logic outside the anti-metaphysical circle surrounding Ockham.

Quantum electrodynamics is the theory of electrons and other elementary charged particles, interacting through the exchange of light quanta. Albert Einstein introduced the light quantum in 1905, but for about three decades physicists applied quantum ideas mainly in theories of the structure and behavior of matter, not to electromagnetic radiation itself, which was always treated semi-classically. This began to change after 1923 with the discovery of the Compton effect and its kinematic description by Arthur Compton and Peter Debye, based on (...) the light quantum. In this paper we review the study of high-energy radiation that led to Compton's discovery. We discuss the analysis of the intensity distribution of Compton-scattered radiation that together with the ''new'' quantum theory beginning in 1925, resulted in the development, especially by Pascual Jordan and Paul Dirac, of a quantum theory of electromagnetic radiation in interaction with matter. In many ways the twentieth century was a turning point in the history of mankind. Rebellious social forces defied any reasonable explanation. Philosophical theories of society that had previously been considered true turned out to be inapplicable to the analysis of new historical processes. To an even greater extent than before, religion began to be used by its ministers in the service of corporate and political interests. The hope of solving the problems of human existence and social development with the (...) help of science was also shaken, for many phenomena of human life and cosmic processes were not amenable to scientific explanation. In spite of the impressive successes of science, which changed the face of the world, a critical, even negative, attitude towards science increasingly took hold of public opinion, for the negative features of the technogenic civilization that science helped to create became more and more visible. There were also cultural crises. Alongside beautiful examples of painting, poetry, literature, music, and architecture, a mass culture ruled by the dark spirit of consumerism, banality, and violence sprang up and entrenched itself. The moral sphere is in serious crisis. First the West and, following it, Russia tasted the bitter fruits of the sexual revolution. All of this was the reflection of a deep spiritual crisis that enveloped mankind, a crisis that became obvious in the twentieth century. (shrink)

On September 18, 1995, the U.S. Court of Appeals for the Seventh Circuit handed down a decision in Blue Cross & Blue Shield United of Wisconsin v. Marshfield Clinic ) that sets two important precedents regarding the status of health maintenance organizations under antitrust law. Chief Judge Posner, writing for the court, concluded that HMOs do not constitute a market separate from the general market for medical services and that agreements, between HMOs in a region, to operate in separate areas (...) constitute a prohibited form of market splitting.This case primarily involves two HMOs in north central Wisconsin: one a subsidiary of Blue Cross, the other a subsidiary of the Marshfield Clinic. The Blue Cross HMO claimed that the Marshfield HMO had an illegal monopoly in the region's HMO market and therefore violated the Sherman Act ). (shrink)

This article covers issues illustrating determining significance of philosophy as a theoretical reflection over the utmost bases of culture as well as processes, conditioned by phenomena of alienation and self-alienation of culture, resulting in its integrity, uniqueness and originality demolition. This, in its turn, definitely leads to various kinds of deformation of philosophic reflection. The most important tendency in subduing the crisis of culture and philosophy is to project a new type of philosophizing, represented in the critical philosophy of “Frankfurt’s (...) School”, and other trends, which emphasize ideas of correlation between philosophy, science, art and morality, and transforming its former states into the new stream of philosophizing and questioning. Variety of philosophic trends, originality of its approaches, variety of its ”images” is determined, to a considerable extent, not only by contradiction of philosophic process, but also by the status of culture, its deformations, its former values devastation as well as forming new ones, decaying of its integrity, embodied in the form of alienation and self-alienation of culture.Self-alienation of culture only reveals alienated character of society itself, both its creators and its consumers, dividing and studying cultural values. Transformations of philosophic ideas appear not only in the form of reconsidering for historic and philosophical process achievements, but also in the form of new forms of society and culture reconsidering, appealing to the future in the outline of its humanitarian development.
